Terms of Use.

Please read these terms carefully before using Third Degree.

Summary: Third Degree is a preparation and training tool. It is not a substitute for qualified professional advice. The AI provides simulated examination and analysis for educational purposes only. By using the app or Web application, you agree to these terms.

These Terms of Use ("Terms") constitute a legally binding agreement between you and Third Degree ("Company," "we," "us," or "our") governing your access to and use of the Third Degree Web application, website at thirddegreeprep.com, and upcoming mobile applications (collectively, the "Service"). By using Third Degree, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use Third Degree. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service. By using Third Degree, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

You must create an account to use Third Degree. You agree to provide accurate, current, and complete registration information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@thirddegreeprep.com if you suspect unauthorized use of your account.

You may not share your account with others, create accounts for other people without their consent, or create multiple accounts to circumvent subscription requirements or other restrictions.

3. Subscriptions and Billing

Third Degree offers paid subscriptions on a monthly and annual basis. Subscriptions are purchased directly through our Web application (Stripe) or via Apple's App Store for mobile editions, subject to standard transaction billing rules.

  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Billing is charged to your credit card or Apple ID at confirmation of purchase.
  • You may manage or cancel your web subscription inside the Profile Settings of the Web App, or via your iPhone's Settings for App Store subscriptions.
  • No refunds are provided for partial subscription periods. Standard refund policies of the respective payment gateway apply.
  • We reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

4. Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Third Degree for personal, non-commercial preparation and educational purposes.

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse engineer, decompile, or extract source code from the application
  • Use the Service to transmit any content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to any part of the Service or its supporting systems
  • Use automated tools, bots, or scripts to access the Service in a way that creates an undue load on our systems
  • Resell, sublicense, or commercially exploit the Service or any content generated by it
  • Upload content that contains malware, exploits, or any code designed to harm our systems
  • Upload documents or content that you do not have the right to use (e.g., confidential third-party documents without authorization)

5. Content You Upload

You retain ownership of any documents, text, or other content you upload to Third Degree ("User Content"). By uploading content, you grant us a limited, non-exclusive license to process and transmit that content to our third-party AI service providers solely for the purpose of operating the Service on your behalf.

You represent and warrant that:

  • You have the right to upload and process the content you provide
  • Your content does not violate any law or third-party rights
  • You are not uploading content that is classified, export-controlled, or subject to legal holds without proper authorization

We are not responsible for the content you upload or for any consequences arising from submitting content you did not have the right to use.

6. AI-Generated Content Disclaimer

Third Degree is powered by large language model AI. All questions, responses, feedback, scores, and analysis generated by the AI are automated outputs produced for training and preparation purposes only.

Important: AI-generated content may contain errors, inaccuracies, or outdated information. Third Degree is not a substitute for qualified professional advice. Specifically:

  • Legal Mode and Deception Analysis are educational tools for preparation practice only. They are not legal advice, not a substitute for qualified legal counsel, and Deception Analysis scores are not evidence of actual dishonesty or deception. Always consult a licensed attorney for legal strategy.
  • Medical or clinical exam preparation content generated by the AI should be verified against authoritative medical sources. Do not rely solely on AI-generated content for patient care decisions.
  • Academic content may not reflect the most current research or your institution's specific curriculum. Use Third Degree as a supplement to, not a replacement for, official course materials.

7. Intellectual Property

The Third Degree app, website, logo, design, features, and all content we create are owned by Third Degree and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, or other proprietary branding.

AI-generated session content (questions, feedback) is generated on your behalf for your personal use. We do not claim ownership of the specific AI outputs generated during your sessions.

8. Privacy

Our collection and use of personal information is governed by our Privacy Policy Trust & Security, which is incorporated into these Terms by reference. By using Third Degree, you consent to the data practices described in the Privacy Policy.

9. Disclaimer of Warranties

THIRD DEGREE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content. Your use of AI-generated content is entirely at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRD DEGREE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Third Degree, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, and 13) will survive.

You may delete your account at any time by contacting us at support@thirddegreeprep.com.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, conducted in New York, New York.

You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notification. Your continued use of Third Degree after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
